The Washington masked police ban ran straight into a constitutional wall days after it took effect. Federal agents in White Center and Burien kept making arrests with their faces covered, and a legal expert on camera said flatly that the state cannot regulate a federal agency this way.
Key Takeaways
- Video showed masked federal agents making arrests in White Center and at 12th and Roxbury in Burien after the ban took effect.
- The Supremacy Clause means states — and cities — cannot regulate the federal government.
- Seattle’s mayor announced steps to bar federal agents from using city-owned property for immigration enforcement.
- The mayor also floated firing city police who cooperate with ICE.
The Supremacy Clause is the constitutional doctrine that federal law overrides conflicting state and local law — which is why a state ban can’t bind federal ICE agents.
Why can’t Washington’s masked police ban stop ICE?
Because ICE is a federal agency, and states can’t regulate the federal government. As the legal expert put it in the clip, if you frame it as the state regulating a federal agency, the answer is simply no — that’s the doctrine flowing from the Supremacy Clause.
The law was pitched as a transparency measure. But when federal agents keep working with their faces covered and nothing changes, the honest question is whether the ban has any teeth at all.
States cannot regulate the federal government.
What is Seattle’s mayor actually proposing?
An executive order barring federal immigration authorities from using city-owned and city-controlled property, plus directing Seattle police to investigate, verify and document reports of immigration enforcement. The mayor also urged the school district and municipal court to adopt similar restrictions.
The catch is that a mayoral executive order reaches only city and local law — it can’t override federal authority. City officials themselves said there’s no current indication of a surge in ICE or CBP activity in Seattle, which raises the question of what problem the order solves.
Can a city really fire police for enforcing federal law?
The mayor suggested she’d support firing officers who cooperate with ICE, which is the crux of the controversy. Seattle Police Chief O’Toole said officers will keep focusing on public safety regardless of immigration status and comply with laws barring participation in federal immigration enforcement, documenting incidents if notified.
But firing officers for following the law of the land, in a department already estimated to be 600 to 700 cops short, points to why recruiting is so hard. The same dynamic shows up when Portland police refuse to support federal enforcement.
Is any of this popular with residents?
Not uniformly. An informal poll cited in the segment showed a lopsided split against the mayor’s plan to monitor ICE and restrict city property use — even in Seattle. The read is that a lot of residents see the effort as virtue signaling rather than public safety.
Reported spending on ICE-related signage in parks — around $45,000 — draws particular scorn given officials say no major raids are expected, including around FIFA events. It fits the pattern flagged in Seattle’s sanctuary-city standoff.
Can anyone actually enforce the mask ban against ICE?
Practically, no. The law creates a civil path to sue if you’re detained by an officer who violates the mask policy, but legal experts quoted in the coverage say enforcing it against federal agents will be difficult, and few detainees have the counsel or standing to try.
An immigration advocate in Burien acknowledged that in the weeks since the law passed, nothing has changed. That’s the core problem with an unenforceable rule — it reads as a statement, not a policy. The broader clash mirrors the federal-versus-local law enforcement reality check.
What does the “defund Seattle” argument claim?
It’s the mirror image of “defund the police.” The argument runs that if a sanctuary city won’t follow federal law — the law of the land — then federal funding should be pulled, and the city can operate on its own resources. Every sanctuary city and state, by this logic, would face the same choice.
Sean pairs it with a hard number: Seattle’s police department is estimated to be 600 to 700 officers short. Directing the officers you do have to verify federal agents’ IDs, the argument goes, pulls them away from prostitution, open-air drug markets and stolen-goods sales that go unaddressed.
Frequently Asked Questions
Does the Supremacy Clause let ICE ignore state law?
In this context, yes — the doctrine means states and cities cannot regulate the federal government, so a state ban on masked law enforcement doesn’t bind federal ICE agents.
Can Seattle keep ICE off city property?
The mayor’s executive order aims to bar federal immigration authorities from city-owned and city-controlled property, but its reach is limited to city and local law.
Has the mask ban changed anything so far?
According to an immigration advocate quoted in the coverage, nothing has changed in the weeks since the law passed — federal agents continued making arrests with faces covered.

Just days after Washington banned masked law enforcement, video showed federal agents in White Center making another arrest, their faces covered. >> We’re working with the police department to make sure that officers are following the rules that we have sent down. Then, this arrest from Burien yesterday at the intersection of 12th and Roxbury shows another masked agent. The new law was meant to increase transparency, but arrests like these raise a bigger question. Does the law actually have any teeth? And if they don’t, then that’s a problem. Do you support firing cops who don’t follow that executive order?
You mean firing cops who do what? >> Can the state regulate a federal agency like this? If you put it that way, the answer is no. In fact, there is a doctrine with respect to that comes from the supremacy clause, and part of that doctrine is that states cannot regulate the federal government. >> Starbucks is brewing up an expansion plan. The Seattle-based coffee giant announced it will be opening a new corporate office in Nashville later this year to support coffee house growth, especially in the Southeast region. And I would like to close with a message to Starbucks. This is your hometown and mine.
Seattle’s making some CHANGES RIGHT NOW. AND I URGE YOU to do the right thing. Jenny Wilson has announced initial steps would address federal immigration enforcement actions in Seattle. In a statement, Mayor Wilson says she is taking, quote, immediate steps to bar federal agents from using city property for federal immigration enforcement activity. That includes requiring Seattle police to investigate, verify, and document any reports of immigration enforcement in the city. >> Because in Seattle, when workers’ rights are under attack, what do we do? When workers’ rights are under attack, what do we do?
When workers’ rights are under attack, what do we do? Because this is your city. Mayor’s also working on an executive order that would prohibit immigration authorities from using property that is city-owned and city-controlled for enforcement activities. She went on to say, “Whoever you are and wherever you are from, if Seattle is your home, then this is your city.” Who Who don’t follow the law? Yes. Sure. Yeah, that are cooperating with ICE. Let’s watch that video again, just one more time on Katie Wilson, Seattle’s socialist mayor, saying she’d be willing to fire cops for enforcing the law, federal law, which always trumps state and city law.
The supremacy clause. Yes, that’s right. But hey, Katie Wilson’s got a different angle on it. Let’s watch it again. Make sure that officers are following the rules that we have sent down. And if they don’t, then that’s a problem. Do you support firing cops who don’t follow that executive order? You mean firing cops who do what? Who Who don’t follow the law. Yes. Sure. Yeah, that are cooperating with ICE. Or working with the police department to make sure that officers That That is the most mentally handicapped thing of all time. Firing cops firing cops for enforcing the law. Firing cops for enforcing the law.
Because whatever Mickey Mouse executive order, and we’re going to get into some of the Mickey Mouse executive orders, whatever Mickey Mouse executive order Mayor Katie Wilson put in place, it has no impact. It has no impact on really anything, and she can fire cops all day long if she wants. But that’s why Seattle should be defunded. If Seattle doesn’t want to doesn’t want to play by federal rules, which are the law of the land, then they shouldn’t get any money. Washington state, same thing. Every sanctuary city, every sanctuary state should be defunded. If you don’t want to play by the rules, then F you, you don’t get the money.
Simple as that. I think that’s fair. I think that’s fair. In a time where all of these big blue cities, counties, and states are just barely getting by because of their massive overspending and fraud, pull that federal funding and let’s see how that goes. I’m curious. Defund Seattle. I’m okay with that. I’d be all right with that because actions have consequences. And when you fire your own police force, which you already don’t have enough of, you’re 6-700 cops shy, who wants to be a cop in Seattle anyway? It No No laws are being enforced. Nobody’s really getting arrested, incarcerated because everybody knows there’s really no law in place.
It’s just a free-for-all. It’s a massive free-for-all of criminality because that’s what socialists want. So, this this exact This notion of this executive order, it’s it’s like, “Yeah, but that’s from the mayor.” And all she can enforce is city and federal law is is so so far above that. So, check out this. Seattle mayor announces plan to block ICE activity, use police to verify federal IDs. And then what? And then what are you going to do? I mean, you’re literally using your police force to basically muck up federal agents enforcing federal law, which is the law of the land? How does that work?
It doesn’t. Defund Seattle. Defund Seattle. Use police to verify federal agent IDs. Why? Why? Why are you doing it? Why aren’t you out uh shutting down the prostitutes? Why aren’t you out shutting down the Johns? Why aren’t you out shutting down the pimps? Why aren’t you out shutting down the drug dealers on Pike and Pine and third? Why aren’t you out stopping open-air drug use, open-air selling of stolen goods in the International District? Well, because you’re out blocking ICE activity, the federal law of the land, and using and being used to verify federal agent IDs. It’s It’s It’s wildly backwards.
Wildly backwards. And yet it’s it’s what we’re doing, right? Seattle Mayor Jenny Wilson has announced a series of initial steps aimed at protecting city residents amid heightened federal immigration enforcement act- activity. They’re getting rid of the criminal illegals. So, that that is heightened immigration enforcement activity? ICE has been doing this for every single administration. It’s just all of a sudden, “Oh my gosh, they’re they’re tossing our our our voter base. Oh, we better stop them. ICE.” Including barring immigration enforcement from utilizing city-controlled property. How much did we spend?
45,000 bucks on signs in parks that ICE was never going to set up at anyway? That is what Seattle is doing. Defund Seattle. Defund Seattle. If you’re going to put up $45,000 worth of signs, and that doesn’t even include the I think that number’s right. The the cost of labor to install them. So, you know what I mean? Defund Seattle. We’ll We’ll just see how Seattle works out without without federal funding. I think I think that’s a real thing. And using city police to verify the identification of federal agents, again, why? Why would you do that? We don’t have federal agents, you know, verifying the identity identity of Seattle police.
What are you so afraid of? You’re just trying to muck up the system. You you’re just trying to do some weaselly Democrat, some libtard shenanigans. These are libtard shenanigans in libtard sanctuary cities, in libtard states. Oh, greatest thing ever. No, it’s not. It’s not. You guys are just you’re mentally handicapped. City officials said there is no current indication of a surge in Immigration and Customs Enforcement or Customs and Border Protection activity in Seattle. Yes, there there’s none. And the mayor has also come right out and said there probably isn’t going to be one for FIFA. There there’s not going to be a massive raid for FIFA, either.
Like, okay. All right, so why are we doing all this? Virtue signaling. Libtard sanctuary city virtue signaling. That’s all that this is. Look at how high and mighty we are. We want to stop federal officers from deporting criminal illegals. We want more criminals in our neighborhoods. We want to be unsafe. We want to be unsafe. But noted an increase over the past year and said preparation is necessary given uncertainty around federal actions. What in the hell are you talking about? You know what I mean? Do you approve of the mayor’s plan to monitor ICE No, L to the no. Let’s see what that looks like.
92 to 8. This is com on. This is a little bit more conservative. Monitor ICE, restrict use of city property. Yeah, so so even in Seattle, people are like, “No, that’s absurd. That is absolutely absurd.” There she is. Whoever you are and wherever you come from. If Seattle is your home, then this is your city. Hey, this has been my city for a long, long time. All my life. And you know what? I welcome ICE coming and deporting criminal illegals. I welcome that. You know why? Cuz that’s the law. This whole This whole other thing, the sanctuary city thing, that’s just a bunch of nonsense. That’s just crap.
It’s just absolute crap. Oh, we’re sanctuaries. Why? Well, cuz you want to cook the books. Wilson said in a statement. She said the city would move quickly to organize, keep people safe. You mean like the ridiculous people out there at the No Kings protest? You mean like those those people? You know, I was watching a Brandi Cruz video this morning and it was a short. And she was talking about you know, it’d be one thing if Democrats were making some moves, if they would recognize that you know, everything that they’ve done, just everything so far left has been what has pushed so many people to go to the right and essentially vote for Trump.
Instead, they continue to blame Trump for their own policy absolute failures. Failures. Men can have babies. Fail. Boys should be playing against girls in girls sports pretending that they’re girls. Fail. Wide open border. Fail. Yeah, this just goes on and on and on. And this is part of that. This is part of that. That whole notion that they think they’re getting somewhere. Keep people safe. From who? It’s It’s like Brandon Johnson. Let’s go Brandon Johnson in Chicago. He’s He’s doubling down on ICE making people unsafe while he’s literally got a murdered young lady because of sanctuary city policy and letting criminals go.
And Biden let that guy go. He’s got that happening. I mean, it is so two-faced. It It’s amazing. It’s amazing that these people think that keeping people safe means not allowing federal agents to follow the actual law. Not this executive order stuff. This executive order stuff is literally just childish nonsense. It doesn’t count. It doesn’t count. Putting little signs up in the park doesn’t count. Nobody cares. Just a massive waste of taxpayers’ dollars. Citing immediate actions to limit the use of city property for civil immigration enforcement, update police protocols, and support community partners.
Under the plan, the mayor will issue an executive order prohibiting civil federal immigration authorities from using city-owned and city-controlled properties. They’re They’re They’re going to do what they want. You know what? And the city isn’t going to do anything. The crazy thing about all these libtards about all these socialists is that when you when you step up and actually have a confrontation with them, they just immediately tumble. They’re They’re small, weak-minded people with no backbone. And that’s what these mayors are. That’s That’s what our governor is. And he’ll hide behind the law and and and do his thing and you know, he’ll Tim Eyman, guy who had $30 tabs for cars, pushed him into bankruptcy because he kept bringing, you know, these these uh legislative deals that actually worked for the people instead of taxing the people under the ground.
Wilson also urged other local government entities, including the Seattle School District and Seattle Municipal Court, to adopt similar restrictions. Why? That’s an enormous waste of everybody’s time. This whole thing is you know, preparing for ice. Well, Obama did a lot of deportations. Huh, weird. He was the king of deportations, right? And then all of a sudden, oh, we don’t like ice. It’s it’s it’s it’s so it’s so crazy. It’s so crazy. Seattle police Chief O’Toole said officers will continue to focus on public safety regardless of immigration status and comply with laws barring participation in immigration enforcement.
That’s stupid. That is stupid. Defund Seattle. Seattle should be defunded. Don’t want to play by the rules? Don’t get the money. Simple as that. While the department has no authority over federal agents or policies, O’Toole said if officers will document incidents if notified. And then do what? Then what are you going to do, Chief O’Toole? What are you going to do? Are you Are you going to have a Kumbaya moment where everybody sits down and just I think we need to talk about this and share our feelings and Seattle Police Department’s primary responsibility is the life safety of all people. Yes, and that includes deporting criminal illegals.
That’s where this whole thing, you know, that’s the rub, right? Yeah, you are tasked and you take an oath that basically says public safety, right? Public safety. But oh, we’re not doing that on the federal level. How come? Oh, cuz we don’t like it. We don’t like it. As part of the changes, the mayor directed Seattle Police Department to investigate, verify, and document reports of immigration enforcement activity. And if they don’t, she wants to fire them. Why would you want to become a cop in Seattle? You wouldn’t. This is why. This is why Seattle is so lawless. You don’t have enough cops. And this kind of absolute tomfoolery shenanigans that this this is why This is why Seattle has such a bad reputation.
This is why Seattle is just, you know, so far gone. My son Cameron came back from a a vacation to LA. Get a little sun. They actually have sun down there Seattle? No sun. Mid 40s raining here. Just continuously. You know, we’re in the tail end of 10 months of the year where it’s just, you know, you want to kill yourself cuz you go outside and you know, leave for work it’s raining, it’s cloudy, go home, it’s cloudy again. Weird. He went down to LA and celebrated his 33rd birthday. And he came back and he said, and he lives in Seattle. He lives in Seattle proper. Lives in Madison Park. He came back and said, “Dad, LA’s not that bad.” And I had him drive through Skid Row.
I had him drive through multiple blocks of Skid Row. And he came back and he literally said, “It’s not LA is not that bad compared to Seattle.” So, you know, Seattle is Seattle is is scratching the bottom of the barrel. They’re really scraping. They’re scraping because of policies like this, where you have leadership basically putting out policy that goes absolutely nowhere. It goes nowhere. Because of what we heard earlier in the video, there’s a little thing in the Constitution called the Supremacy Clause. Oh. Huh. Weird. It’s like when AOC said, “Well, that would be part of the the Constitution.” I can’t remember what she was talking about.
And it was I think she was talking with Tom Homann and he said, “Well, it is.” You know what I mean? That tiny little thing, the Supremacy Clause. Federal law trumps state and local. And we are literally talking about local law. Local law, right? Local law. It’s It’s Washington banned masked law enforcement. ICE agents are still covering their faces. Can anyone enforce them? Is it Isn’t this just I mean, this is such standard lip-tard nonsense. This is such standard sanctuary city just absolute stupidity. Can anyone enforce them? So, you’re going to go out, you’re going to spend a bunch of money, you’re going to you know, you’re going to dictate these executive orders.
And then the media literally says, uh yeah, legal experts say enforcing the law against federal agents may be difficult. Do you think? Now, what they’ve done is they’ve made it a case where on a civil basis, you can sue if you’ve been impacted by federal ICE agents. It’s like literally, who’s going to do that? You want to take on the federal government? All right, roll the dice. Let’s just see what happens. Let’s just see what Let’s just see what happens. I mean, why not? I’m I’m I’m in. Are you? To have somebody, you know, file a lawsuit. The new law was intended to increase transparency. You know what?
I’m so tired of hearing about transparency because you know what happens? It actually just gets worse. There’s no transparency. Nobody cares. Transparency. But arrests like these are raising a bigger question. Does the law actually have any teeth? We heard the lady in the video say, “If you put it that way, the answer is no.” There is a doctrine that comes from the supremacy clause. States cannot regulate the federal government, nor can cities. Simple as that. So, the idea is if you detain If you’re detained by an officer who breaks the new policy against masks, you can sue. Theoretically. Unfortunately, what we’ve seen in the past couple of weeks, it’s just that law was passed was that nothing has changed.
I’m sorry, what? I I’m sorry, I couldn’t hear you. Nothing changed? Oh, shocker. That is a shocker. That’s from Sandy Restrepo with the Colectiva Legal del Pueblo in Burien. Ah. So bad. So bad. So bad. They don’t know who is arresting them. They don’t know the name of the person and a lot of them don’t have legal assistance. Well, that’s because they’re criminal illegals and they are they have a deportation order and ICE is tossing them out of the country. So, there’s that. There’s that little fact there. I don’t think it’s very likely given the legal obstacles people have already obtaining legal counsel.
Nobody is going to sue. Nobody’s going to sue. The whole thing is just a sham. Therefore, let’s defund Seattle and see if they come back in line. I I say I say we make it a thing. Defund Seattle. We had to defund the police, right? That was one of the stupidest concepts of all time. Just on on the the level of ridiculousness, defund the police was was one of the stupidest stupidest things ever. Cuz it’s like, well, what do you think might happen when a whole bunch of cops leave? Oh. Kind of looks like Seattle. Weird. Oh, this isn’t good. Well, I hope we can get this crime under control. I hope.
You know, it just it doesn’t work like that. It doesn’t work like that. So, let’s let’s defund Seattle in general. Take away all federal funding from Seattle. And we’ll just, you know, we’ll we’ll see what happens. I mean, we gave that defund the the police, you know, actual law enforcement, holding that thin blue line in society, we gave that a rip. Why Why we give the you know, Seattle a shot and just let them let them work autonomously. If if they don’t want to follow federal law, let’s see how they do on just their own law. And I’m all for that. You just can’t get any federal funding. I think that’s what we should do.
I think that’s what we should do. And I think that’s what we should do with all sanctuary states, all sanctuary cities. Ah, you guys don’t want to follow the law of the land? All right, that’s fine. No problem. Funding pulled. Ah, wouldn’t that be great? Could you imagine day one? Uh, we have got a budget that has a deficit. I’d love that. Oh, I would podcast that here to the moon. So, is that going to happen? No. But, would it be entertaining? Yes. Would it would it be I told you so? Absolutely. If it does, man, greatest thing ever. Thanks so much for being here. Love to have you subscribe, hit that notification bell.
I’ll see you in the next episode. Thanks again for joining. Bye for now.
